TICA’s position on important tax, tenant-in-common (TIC), securities, real estate issues or other issues affecting the TIC industry are defined and articulated through member participation, staff involvement and grassroots communication.

The TICA legislative and regulatory committee evaluates proposed and pending legislation, member recommendations and other issues that may affect TICs.

Current Issues
Representative Smith of Nebraska introduced the Farmland Relief Act of 2007 (H.R. 3039) that, if passed, will double the time limits under §1031 (45 days to 90 and 180 days to 360) to complete. Read more about the act .

TICA issued a position statement regarding TIC’s as securities.

Past Issues
Montana Legislation proposed Bill 256 to exempt TIC transactions from state securities law.

Oregon Legislation—Senate Bill 449—would treat TIC’s as real estate transactions and not subject to securities law.
